Plots allotment to judges, bureaucrats: SC nullifies IHC’s order
The Supreme Court on Wednesday quashed the Islamabad High Court’s decision regarding the allotment of plots to judges and bureaucrats in the posh sectors of Islamabad.
Islamabad High Court had declared the allotment of plots to retired high court judges and bureaucrats in the post sectors of F-14 and F-15 in Islamabad as unconstitutional.
Announcing its reserved verdict on the case, Justice Ayesha Malik in a short order nullified the decision of the Islamabad High Court and accepted the appeal of the Federal Government Housing Authority, and asked the lower court to review the matter.
On May 21, a three-member bench headed by Justice Munib Akhtar had reserved the verdict.
In February 2022, a two-member bench of the Islamabad High Court (IHC), led by former Chief Justice Athar Minallah, declared the allotment of plots in Islamabad’s F-14 and F-15 sectors unconstitutional and against public interest. The IHC had ruled that state land is meant for public welfare, not for the elite.
Following the verdict, the Federal Government Housing Authority and retired bureaucrats filed appeals in the Supreme Court.
The disputed allotments, conducted through balloting, included plots for former Chief Justices Umar Ata Bandial, Gulzar Ahmed, Anwar Zaheer Jamali, Amir Hani Muslim, Khilji Arif Hussain, and other judges and bureaucrats.
The Supreme Court has now nullified the IHC’s decision, reigniting debate over the distribution of state resources.
